RETURN AND EXCHANGE OF GOODS
The procedure for returns and exchanges depends on where the work was purchased. The legal acts of the Republic of Lithuania set out different rules for purchases made in the online shop and for purchases made at the studio, so both cases are described separately.
1. Works purchased in the online shop ramunesnameile.lt
A purchase made in the online shop constitutes a distance contract. The Buyer has the right to withdraw from it within 14 days without giving any reason.
1.1. Time limit
The 14-day period is counted from the day on which the Buyer, or a person indicated by the Buyer other than the carrier, receives the work. If several works ordered together are delivered separately, the period is counted from the day the last work is received.
1.2. Notice of withdrawal
Notice of withdrawal shall be sent by e-mail to info@ramunesnameile.lt. A clear statement that you are withdrawing from the contract is sufficient. You may also complete the model withdrawal form.
Please state the invoice number in your notice. It allows the purchase to be identified more quickly, but the notice is valid without it.
1.3. Returning the work
The work shall be dispatched or delivered within 14 days from the day the notice of withdrawal was given. The direct cost of return shipping is borne by the Buyer.
Return address: Vilniaus g. 134, Šiauliai, Lithuania.
1.3.1. Returns from Norway and Switzerland
Norway and Switzerland are outside the customs territory of the European Union, so customs procedures apply to a returned parcel. The shipping costs and the costs of the customs procedures are borne by the Buyer.
The shipping documents should state that these are returned goods. This way the parcel is not charged import duties in Lithuania. If import charges fall to the Seller because the documents were completed incorrectly, they are deducted from the amount refunded.
The import value added tax that the Buyer paid when collecting the parcel is not refunded by the Seller. The Buyer may apply for its refund to the customs authority of their own country.
1.4. Condition of the work and of the signature box
You may examine, try on and assess the work in the same way as you would in a shop. The Buyer is not liable for such examination.
The shipping packaging may be opened and taken apart. Damage to it is not treated as diminished value.
The signature box is part of the work, not shipping packaging. It is made individually for each work, its value is included in the price of the work and is stated in clause 1.4.1. The returned work shall therefore be sent together with its signature box.
1.4.1. The value of the signature box depends on the size of the work and of the box:
- for ceramic works, from 10 to 15 euros;
- for jewellery works, from 4 to 8 euros.
If the work or the signature box has been handled beyond what is necessary to establish the nature, characteristics and functioning of the work, and its value is thereby diminished, the amount refunded is reduced by the amount of the diminished value. In the case of the signature box, the reduction shall not exceed the value of the box for that particular work, as stated in clause 1.4.1.
It is recommended to enclose the document confirming the purchase. This is not a condition of return, but it allows the condition of the work to be assessed and the money to be refunded more quickly.
1.5. Refund
The refund shall be made no later than 14 days from the day the Buyer's notice of withdrawal was received. The price of the work and the delivery costs paid by the Buyer are refunded.
If the Buyer chose a delivery method more expensive than the cheapest standard method offered by the Seller, the difference in price is not refunded.
The refund is made using the same means of payment as was used for the purchase, unless otherwise agreed.
The refund may be withheld until the work is returned to the Seller or until the Buyer provides evidence that the work has been dispatched, whichever occurs first.
1.6. When the right of withdrawal does not apply
The right of withdrawal does not apply where the work has been made to the Buyer's individual specification or is clearly personalised for the Buyer:
- 1.6.1. works bearing an imprint chosen by the Buyer: a name, a date, initials or a symbol;
- 1.6.2. works whose size, length or other physical characteristic has been altered at the Buyer's request;
- 1.6.3. works that are made only after an order is placed and that carry a mark specified by the Buyer.
For every such work this restriction is stated separately, on the page of that work, before the order is placed.
The maker's responsibility mark and the hallmark of the Lithuanian Assay Office are not personalisation. They denote the authorship of the work and the fineness of the metal, and therefore do not restrict the right of return for works bearing only these marks.
Works from the existing collection sold without personalisation specified by the Buyer are returnable under the general procedure.
2. Works purchased at the studio
Different rules apply to purchases made at the studio at Vilniaus g. 134, Šiauliai.
The exchange and return of goods of satisfactory quality is governed by Article 6.362 of the Civil Code, and the list of goods that may not be exchanged or returned is set out in the Retail Trade Rules. That list includes:
- 2.1. pearls, precious stones, precious metals and articles thereof, other than costume jewellery (clause 17.12 of the Rules);
- 2.2. works of art, collectors' items and antiques (clause 17.23 of the Rules).
A jewellery piece or work of art of satisfactory quality purchased at the studio may be exchanged or returned only with the Seller's consent. At the studio the work is examined, tried on and assessed in person, which is why this provision is justified.
If you wish to return or exchange a work, please get in touch. Every case is considered individually.
3. Works of unsatisfactory quality
If a work of unsatisfactory quality is delivered to the Buyer and its defects were not agreed with the Buyer in advance, the Seller carries out the exchange or return at the Seller's own expense. In such a case both the price of the work and the delivery costs are refunded.
This right applies regardless of where the work was purchased.
